This privacy policy is adapted to the current Spanish and European regulations on the protection of personal data on the internet. Specifically, it complies with the following regulations:

Registration of Personal Data

In compliance with the GDPR and LOPD-GDD, we inform you that the personal data collected by ANDA Marketing Estratégico through the forms on its pages will be incorporated and processed in our database in order to facilitate, expedite, and fulfill the commitments established between ANDA Marketing Estratégico and the User, or to maintain the relationship established in the forms filled out, or to respond to a request or inquiry. Furthermore, in accordance with the GDPR and LOPD-GDD, unless the exception provided in Article 30.5 of the GDPR applies, a record of processing activities is maintained specifying, according to its purposes, the processing activities carried out and the other circumstances established in the GDPR.

Principles applicable to the processing of personal data

The processing of the User’s personal data shall be subject to the following principles set out in Article 5 of the GDPR and Articles 4 and subsequent ones of Organic Law 3/2018 of 5 December on the Protection of Personal Data and the guarantee of digital rights:

  • Lawfulness, fairness, and transparency: The User’s consent will always be required after full and transparent information about the purposes for which the personal data are collected.
  • Purpose limitation: Personal data will be collected for specified, explicit, and legitimate purposes.
  • Data minimization: Only the personal data strictly necessary for the purposes of processing will be collected.
  • Accuracy: Personal data must be accurate and kept up to date.
  • Storage limitation: Personal data will be kept only for as long as necessary for the purposes of processing.
  • Integrity and confidentiality: Personal data will be processed in a manner that ensures their security and confidentiality.
  • Accountability: The Controller shall be responsible for ensuring compliance with the above principles.

Categories of personal data

The categories of data processed by ANDA Marketing Estratégico are solely identifying data. In no case are special categories of personal data processed within the meaning of Article 9 of the GDPR.

Legal basis for processing personal data

The legal basis for processing personal data is consent. ANDA Marketing Estratégico undertakes to obtain the User’s express and verifiable consent for the processing of their personal data for one or more specific purposes.

The User shall have the right to withdraw their consent at any time. Withdrawal of consent shall be as easy as giving it. As a general rule, withdrawal of consent will not condition the use of the Website.

In cases where the User must or may provide their data through forms to make inquiries, request information, or for reasons related to the content of the Website, they will be informed if the completion of any of these forms is mandatory, as they are essential for the proper conduct of the operation carried out.

Purposes of processing personal data

Personal data are collected and managed by ANDA Marketing Estratégico to facilitate, expedite, and fulfill the commitments established between the Website and the User or to maintain the relationship established in the forms the User fills out or to respond to a request or inquiry.

Personal data of minors

In compliance with Articles 8 of the GDPR and 7 of Organic Law 3/2018 of 5 December, only persons over 14 years of age may lawfully give their consent for the processing of their personal data by ANDA Marketing Estratégico. In the case of a minor under 14 years old, parental or guardian consent will be required, and processing will be lawful only to the extent that they have authorized it.

Confidentiality and security of personal data

ANDA Marketing Estratégico undertakes to adopt the necessary technical and organizational measures, appropriate to the level of security based on the risk of the data collected, to guarantee the security of personal data and prevent their accidental or unlawful destruction, loss, or alteration, or unauthorized communication or access.

The Website has an SSL (Secure Socket Layer) certificate, ensuring that personal data are transmitted securely and confidentially, as the data transmission between the server and the User, and in feedback, is fully encrypted.

However, since ANDA Marketing Estratégico cannot guarantee the invulnerability of the Internet or the total absence of hackers or others who may fraudulently access personal data, the Controller undertakes to notify the User without undue delay when a personal data breach occurs that is likely to result in a high risk to the rights and freedoms of natural persons. In accordance with Article 4 of the GDPR, a personal data breach means any breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to personal data.

Personal data will be treated as confidential by the Controller, who undertakes to ensure, through a legal or contractual obligation, that such confidentiality is respected by employees, partners, and any person to whom the information is made accessible.

Rights arising from the processing of personal data

The User has the following rights, as recognized in the GDPR and Organic Law 3/2018 of 5 December on the Protection of Personal Data and guarantee of digital rights, and may therefore exercise them against ANDA Marketing Estratégico:

  • Right of access: The right of the User to obtain confirmation as to whether ANDA Marketing Estratégico is processing their personal data and, if so, to access specific information about those data and the processing carried out.
  • Right to rectification: The right of the User to have inaccurate or incomplete personal data corrected, taking into account the purposes of the processing.

  • Name, surname, and a copy of the User’s ID document. If representation is permitted, identification of the representative and proof of representation will also be required. The ID copy may be replaced by any other legally valid means that proves identity.
  • The specific request or information to which access is sought.
  • Address for notifications.
  • Date and signature of the applicant.
  • Any supporting documents.

Complaints before the supervisory authority

If the User believes that there is a problem or violation of current regulations in the way their personal data are being processed, they have the right to effective judicial protection and to lodge a complaint with a supervisory authority, particularly in the State where they have their habitual residence, place of work, or place of the alleged infringement. II. ACCEPTANCE AND CHANGES TO THIS PRIVACY POLICY

It is necessary that the User has read and agrees with the terms regarding the protection of personal data contained in this Privacy Policy and consents to the processing of their personal data so that the Controller can proceed accordingly, in the manner, within the time limits, and for the purposes stated. Use of the Website implies acceptance of this Privacy Policy.

ANDA Marketing Estratégico reserves the right to modify its Privacy Policy at its own discretion or due to legislative, jurisprudential, or doctrinal changes from the Spanish Data Protection Agency. Changes or updates to this Privacy Policy will not be explicitly notified to the User. Users are encouraged to check this page periodically to stay informed of the latest updates.
